1. Scope

1.1 These Terms of Use govern all services provided by get-rated.com (hereinafter referred to as "Provider") to the user (hereinafter referred to as "Customer").

1.2 Any conflicting terms from the Customer are not accepted unless the Provider expressly agrees to them in writing.

2. Service Description

2.1 The Provider offers a platform where Customers can upload their dating photos to be rated by other users.

2.2 Customers can use the service for free and earn ratings by rating other users' photos. Alternatively, Customers can purchase credits to receive guaranteed and faster ratings.

3. Usage Rules

3.1 It is strictly prohibited to upload photos containing nudity, minors, photos not containing any people, or any form of violence, gore, or depiction of harm or hate.

3.2 The Provider reserves the right to remove photos that violate these rules without prior notice and to suspend the user's account.

4. Payment Terms

4.1 The prices for credits are listed in the current price list on get-rated.com.

4.2 The Customer can make payments via in-app purchase, credit card, PayPal, or other payment methods offered on get-rated.com.

4.3 Payment is due immediately and without deductions.

5. Liability

5.1 The Provider is fully liable for damages caused by intent or gross negligence.

5.2 For slight negligence, the Provider is only liable for breaches of essential contractual obligations. In such cases, liability is limited to foreseeable, typically occurring damages.

5.3 The Provider assumes no liability for the content of photos uploaded by users or ratings given by users.

6. Data Protection

6.1 The Provider commits to handling users' personal data in accordance with applicable data protection regulations.

7. Final Provisions

7.1 The laws of the country where the Provider is headquartered shall apply to contracts between the Provider and Customers.

7.2 Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.

7.3 For any disputes arising from the contractual relationship between the Customer and the Provider, the place of jurisdiction shall be the Provider's headquarters, provided the Customer is a merchant, a legal entity under public law, or a special fund under public law.
